Autobody got $8k to fix my car, they didnt fix it?!?!??!?

1. Aileron Says: I have a 2006 Volvo S40 that was in excellent shape, I got rear ended by a ford pick up truck at 45mph. The damage was pretty extensive. I was given $8,000 by the other insurance company to get the car fixed. Now my mistake was i didn't got to a shop they had approved. The frame is still crushed and twisted in the rear of the car, the quarter panel(which they got paid to REPLACE) is all body putty the natural lines in the do not match at all when they tried to match to the other quarter panel. There is still a lot more damage on the car that were not fixed but they got paid for. My husband wants to call the auto body and try to get th money back. Is there any other way to get it back to get my car fixed? I know the insurance company wont want to hear it since i picked the place, but its fraud will they help at all?
2. Joe Says: You should call your insurance company and tell them what is going on and have then inspect the car. Even if you didn't choose the collision center that they suggested, there is no law requiring you to do so, they will still want the car fixed correctly. If they find that the repair shop charged for work that they didn't perform, they will step in and help you deal with them to get your car repaired correctly. Not doing the work that they got paid for is insurance fraud and insurance companies take it very seriously when a shop takes their money but doesn't perform the work.
3. mailbox1024 Says: Go with Joe's suggestion, he sounds like he has the knowledge to help you with your problem. All i can say is to visit a lawyer, the 1st consultation is free and he can advise you of your rights and you may have a case to go to court. You will be helping other unsuspected customers from getting ripped off by this body shop as well.

4. Gadget Says: The probably used Aftermarket parts. From what you're explaining. 8k is not going to cover much. The back bumper on a car ALONE cost 4k - 6k. Sounds like they should of declared your car totaled.
5. Integra Type R Says: This has fail written all over it. You NEVER just take a check unless you don't plan on fixing it because they will lowball you everytime, i'm sure they should have totalld out the car now it will never be safe again due to crumple zones being used up

Short of going to court, there's not much you can do.....sorry.
