Should i tell what i know is wrong with a vehicle?
(2011-01-31 15:30:26) 1. Says: i am selling my 85 dodge rampage and it has several issues. it burns a lot of oil, suspension is shot, loses power on hills and vibrates badly at higher speeds. it has other flaws too numerous to mention but as long as i say i am selling it " as is " i should not have to tell a potential buyer everything I know , right? I am just allowing test drives around the block and I say its a very dependable car, which is basically true. I can depend on it to do everything mentioned above. LOL. But seriously, I think anyone buying a car that old should expect it to have a few imperfections.2. Says: WRONG, You can't lie to potential buyers. If you intentionally mislead them you are liable for fraud.Selling a car "as is" means the car comes with no warranty and the buyer accepts the car in the condition he receives it in, It doesn't mean you are free to deceive the buyer.
Deal with honesty and integrity or don't deal the car at all.
Another thing, you can't deny buyers their right to test drive the car and inspect it. If I wanted to drive your car 25 miles down the highway you have no right to deny that. If I wanted to take your car to my mechanic for an inspection you have no right to refuse.
Describe your car accurately, sell it cheap and live your life with a little self respect and integrity.3. Says: That is a really sh*tty thing to do! If you are dishonest about a car then that person can technically take you to small claims court, but chances of them winning is slim, if you get them to sign the title "as is". I mean its an 85 so people are gonna expect problems and youre probably not gonna get much for it anyways! I would say be honest or sell whatever parts on the car that are still good4. Says: whats that you are trying to sell a crappy car, and lying like hell because after you drove/ beat the pee out of it, did not fix anything, you want to dump it on some unsuspecting person? wow what a man, hey, here is an idea, try acting like a man, and telling the truth, you have a 40 dollar car, and you want 30 bucks for it,5. Says: No you don't have to tell them anything, play dumb, but I think you should tell them at least the above... They'll figure out that you really meant AS IS. Then again you get what you pay for.
(If the vehicle is unsafe to drive then you should definitely tell them to bring a trailer for pick up.)6. Says: The buyer will discover these problems during the test drive. If you don't disclose the problems you are nothing less then a THIEF. You are stealing someones money under false pretenses. Everyone hates a THIEF.
