If she operated outside your permission, she pays. For example, if you said she could use it to got to school and it broke down coming or going to school, you pay. If instead of going to school she went shopping, she pays because she didn't have your permission to do that. If she operated the car recklessly, she pays. If you lent her the car without any restrictions you pay. Of course, if it goes to court it's up to the judge to decide.4. Says: Whoever is USING it for their purpose. When you borrow something you take responsibility to return it to the owner in the SAME (repairs included) condition as you received it.Of course if YOU knew it was likely to break down then "Man-up" and do the right thing,
And of course if you continue to want trade in services from her then you might Man-up also?5. Says: Depends did she call and say hey your car broke down what you want me to do? Or did she take it upon herself to have it towed. Personally i have friends with trucks and trailers so I'd never call for a tow truck. then it would be on her to pay (shoulda called me).
If question is it broke while she's driving who is responsible for bill. Unless she obviously caused failure ran into ditch or curb to cause flat tire over heated it till head gasket blew etc. Then its your car and your responsibility to pay for tow and repair.6. Says: I think it depends on why it broke down. If it was something you did to make the car inoperable, then you should pay. If its something mechanical with the car that was no fault of yours, then she should pay. Odds are if she had been driving it, it would have broke down also.7. Says: If your friend won't pay and you want your car back you will have to.
If your friend had not borrowed the car it would have broken down the next time you went out in it so your friend saved you a bit of hassle didn't she.8. Says: If she does not offer then you pay and then never lend out anything to her again.9.
