How long after an accident and no police report can you file a claim?

Says: after a minor rear end accident... if we pulled in a parking lot, both got out... the driver who got rear ended said " i see no damage, i dont think we should ask exchange insurance, but ill just want your name and phone number in case" ... no police report files or called... no damage to both cars ( maybe only a few scratches, barley noticable that may not have even been caused by the accident...but no proof.) the whole situation only lasted 5 min...what could happen now... can the driver who got rear ended file a claim... with no proof, witnesses, police report.. and after saying no damage was done and we could just leave it at that???2. Says: You are going to great length to convince us that you did nothing wrong, however you did do something wrong. You did not call the police and make out a report. For whatever reason you did not do that and now the other driver can file a claim against you and it is just their word against yours. If this should end up in court, you are presumed guilty even before the trial starts, you rear ended them, so therefore you are at fault and at their mercy. Whip lash is extremely hard to disprove and sometimes the symptoms do not show up for a day of so. Your insurance company could cancel you out and not defend you because of your negligence.3. Says: Insurance companies insist on a police report. I wouldn't worry about it, chances are real high that they didn't have insurance because they didn't want the police involved. Tex is off base here. If there's no police report, a name and phone number proves nothing. I've never heard of an insurance company coming after someone without a police report to back it up.4.
