Help. I rear ended someone..?
(2012-02-04 15:25:02) 1. Says: I was driving to school this afternoon and there was this car up the road from me. I couldnt really tell if they were stopped or not so I pressed on my brakes a little but as I got closer I realized they were at a complete stop, so I slammed on my brakes, but I was still going too fast and rear ended them. I was given a ticket for following to close (which I wasnt) and I have a court date. Can anyone tell me what's going to happen? I'm 18 and I've only had my license for a little under a year.Also about my car. It's a 2002 Mustang. The headlight on the left is now gone and the bumpers falling off a little. Someone was telling me that since the airbags deployed theyre probably going to total it. Is this true? Is there any way I'll be able to fix and keep my car?2. Says: First, you were following too close! If you hit him before you could stop you were too close, period. Pay the ticket and thank your lucky stars they didn't charge you with reckless/careless driving. If you have lots of money you could look into hiring someone, usually ex-cops, who look into reducing or eliminating sentences. You'll be fined and have restrictions placed on your licence, and your insurance will go up, but you won't lose your licence, and if you stay clean for a year you'll be OK. Sounds like your car can be fixed for a couple hundred dollars, except for the airbags, which cost a lot to replace. Maybe see if you can take them out all together, if not, ask if you can get cheaper ones from a wreckers.3. Says: im pretty sure they cant just take your car... insurance will ask you if you to fix it or to sell it to a junk yard... umm and about the ticket i think its safer for you to just pay the ticket cause they could give you reckless driving because thats what i got once...
and btw if you have the chance get someone to fix it because body shops RIP you off...4. Says: Ok,you were cited for following to close,you can appeal this if you choose and realize in no way can they now trump your charges up to reckless driving...not after the fact...I suspect they may total your car but if they do ,i did quick kelly blue book value...A 02 mustang v-6 avaerage is 3300 and a gt is about 4500 ...your area could be off a little, but if they total it they will offer it back to you for about 500.00 . Depending on your state ,like mine you have to get a salvaged title forever.it hurts resale value. talk to mechanic/ auto body person to see if u have to fix the airbag for the car to perform...if u do dont buy it back,let the car go...But yes your car ins will go up .nothing you can do about that,legally your in no trouble and cant be ..Just be safe and thank your lucky stars you or nobody else was hurt.5. And you thought they were still moving because they had no good reason to stop, right?
BTW, in most states a cop cannot write a ticket for a violation they did not see.
Put the cop on the stand and ask him if he saw you following too close. When he says no, dismiss him with "No further questions".
When you get your insurance offer, insist that the car is not totaled and is worth more than that. They will give you the check and the car, which they do not want.
Have your car moved immediately to a body shop for an estimate. It is prolly getting storage charges already.
Have your car fixed by a home mechanic with junkyard parts.
